Suspended Chief Magistrate wants to make submission on Bosasa charge

The suspended chief magistrate, Desmond Nair, appeared briefly on Wednesday on a charge of corruption before the commercial crime court in Pretoria.

His case has now been postponed until August so that he can make representations/submissions to the Office of the National Director of Public Prosecutions (NDOV) to request investigations and intervention.

His lawyer, Danie Dörfling, put it in writing that they would submit a request for Shamila Batohi, the national director of public prosecution, to intervene and investigate Nair's prosecution process.

Dörfling did not expand on why Nair wants to request Batohi to intervene. He also did not say what aspects of the prosecution process should be investigated.

Nair is facing charges of corruption after receiving payment in the form of an electric fence, an alarm system, sensor rays and a closed -circuit television system from African Global Operations. The company was previously known as Bosasa.

The renovation work was done in September 2016 at his home in Silverton in Pretoria and cost about R200 000.

The state argued that Nair acquired the renovation work for its influence to act in a dishonest, improper or illegal way.

Justice and Correctional Services Minister Ronald Lamola has provisionally suspended Nair in February 2020 pending an investigation into his suitability for the position as a magistrate. Nair handled, among other things, high -profile cases such as the bail application of former Paralympic athlete Oscar Pistorius.
